Boreal Community Terms and Conditions of Use and Rules

You can use our Products only if you have the legal capacity to form a binding contract and comply with all applicable laws. You must be at least 16 years old to use our Products.

If you open an account with Boreal, you must provide us with accurate and complete information so that we can create, verify and maintain your account.

We may allow you to use our Products on a limited basis without opening an account, for example, by allowing you to participate in live audio conversations. To do this, we may ask you to provide identifying information such as your name, which will be visible to other users during your participation.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Products, subject to these Terms and our policies. If you use the Products on behalf of a company or other entity, you guarantee that you have the authority to bind that entity to these Terms.

By providing us with your phone number or email, you agree that we can contact you via text or electronic messages, provided that we obtain your consent when legally required.

Our Products allow you to interact with other users through live audio conversations, which are automatically recorded. You can also share audio or text content, such as biographies and comments in conversations. Anything you post or make available on our Products is considered “User Content”.

By participating in audio conversations on Boreal, you acknowledge that the audio recordings generated on the platform are co-owned by Boreal and you as the creator or participant of those conversations. This co-ownership allows Boreal to preserve, use, distribute and modify audio content in accordance with these Terms and our Privacy Policy. However, we grant you rights to request the removal of content in accordance with the policies specified in the privacy section.

By sharing User Content on Boreal, you grant us a worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, modify, create derivative works and distribute your content in order to operate and improve our Products. This license also includes the ability to share your content with our service providers, such as Amazon Web Services (AWS), for the provision of services.

You are responsible for any activity that occurs on your account and for the content you share. By sharing content on Boreal, you declare and guarantee that you have the necessary rights to it. We reserve the right to remove or modify any content that we believe violates these Terms or our policies.

At Boreal, live audio conversations are automatically recorded and stored indefinitely to ensure compliance with our Terms and Conditions and Privacy Policy. These recordings allow us to investigate potential violations of our rules. As a user, you acknowledge that both you and Boreal are co-owners of these recordings. If you're the moderator of a conversation, you have the option to delete the recording from your profile.

We want Boreal to be a safe, respectful and welcoming environment for everyone. These Community Standards describe behavioral expectations within the platform and form an integral part of our Terms and Conditions of Use. By using Boreal, you agree to comply with these rules:

• Prohibition of hate speech: Any content that promotes hate, racism, sexism, homophobia, xenophobia, or any other form of discrimination will not be tolerated. Any content that incites hate or discriminates based on race, religion, national origin, age, gender, gender identity, sexual orientation or disability will be removed and responsible accounts will be suspended.
• Prohibition of harassment and doxxing: Boreal will not be allowed to be used to intimidate, threaten or harass other members. Doxxing, that is, the publication or disclosure of personally identifiable information without the individual's consent, is strictly prohibited and will result in a permanent suspension.
• Child protection and inappropriate content: Boreal prohibits any type of content that could endanger minors. This includes sexualizing, exploiting, or soliciting minors, as well as sharing graphic, abusive, or inappropriate content with them. In relevant cases, Boreal will report these incidents to the competent authorities.
• Disinformation: We do not allow the dissemination of false information that could cause harm, such as misinformation about health, elections or civic processes, or manipulated content intended to cause harm or confusion.
• Illegal activities and unauthorized sales: It is prohibited to use Boreal to share illegal content or carry out unauthorized activities, including illegal or highly regulated sales, fraudulent financial schemes, or scams.
• Intellectual Property Violations: We don't allow content that infringes the intellectual property rights of others. If you believe that your content has been misused, you can file a complaint by following our copyright infringement procedures.
• Promotion of violence or extremism: The use of Boreal to promote terrorism, violence, or extremist ideologies will not be tolerated. Any promotion or exaltation of violence, terrorism, or extremism will lead to an immediate suspension of the account.
• Suicide or self-harm: Encouraging or promoting acts of suicide or self-harm is prohibited. If you identify someone at risk, we encourage you to report them in the app or contact support organizations.

Consequences of non-compliance

Our Products may contain links or integrate with third-party services that are not owned or controlled by Boreal. We assume no responsibility for third-party services, content, products, or sites. By accessing these services through our Products, you do so at your own risk and Boreal will not be responsible for any damage or loss resulting from your interaction with them.

We are continuously improving our Products, which means that we may add, modify or remove features without notice. We reserve the right to suspend or stop the provision of our Products at any time, without liability to you.

Boreal may suspend or terminate your account at any time, with or without reason or notice. If you violate any of these Terms, your authorization to access our Products will automatically terminate.

If you witness any activity that violates our Community Guidelines, such as hate speech, threats or harassment, you can report it directly to admin@appboreal.com. Our moderation team will investigate the incident and take appropriate action, which may include the removal of content, the suspension of accounts, or the expulsion from the platform.

All intellectual property rights related to Boreal Products, including but not limited to software, databases, user interfaces, design, graphics and other visual elements, are the exclusive property of Boreal or its licensors. Copying, distributing, reproducing or creating derivative products based on these elements is not permitted without our express written authorization.

By using Boreal, you agree not to use our Products for illegal, fraudulent or unauthorized activities, or to violate any local, state, national or international law. It is prohibited to use the platform to disseminate false, misleading information or to infringe the intellectual property rights of third parties.

The creation of multiple accounts by the same user for the purpose of manipulating conversations, carrying out fraudulent activities or evading sanctions is not allowed. We reserve the right to suspend or close accounts if we detect that a user is managing multiple accounts for unauthorized purposes.

You can close your account at any time by sending a request to admin@appboreal.com. Once your account is closed, we will delete or anonymize your personal data in accordance with our Privacy Policy. However, content that you have shared in third-party spaces, such as conversations in which you participated, may continue to be available on the platform.

To the maximum extent permitted by law, Boreal will not be responsible for any indirect, incidental, special or punitive damages, or for the loss of data, income or benefits that result from your use or inability to use our Products.
